Text messaging leads to felony charge

In what may very well be a legal first for short messaging, a convicted sex offender faces a felony contempt charge after sending text messages to his ex-girlfriend in violation of an order of protection, state police said, reports New York's record online.

"State police said the woman got a Family Court order of protection last month that bars Nicholas Fonseca, 25, of Liberty from contacting her or her children in any way. The order isn't related to the sex offense Fonseca committed in 2000.

Police said Fonseca sent a text message to the woman's cellular phone, then went to her home in Liberty. Both actions violated the order of protection, they said.

Fonseca was charged Tuesday with first-degree criminal contempt, a felony."
